Child Custody Battles
There are a few different types of custody. The living residence of a child refers to physical custody. Often parents are granted shared custody indicating the arrangement is close to a 50/50 time split. Legal custody grants decision-making authorities for the child. Sole custody is when one parent has both physical and legal custody of the child. Custody is always subject to modification by the court.
Child Support Issues
Child support is based on a formula. The formal uses both parties’ net incomes. Child support has three components. One is the actual weekly amount. The second is work related childcare and the third is uninsured medical expenses, which are apportioned between both parties. There are certain reasons why someone could be ordered to pay more or less than what the child support requires. For instance, if you have shared physical custody, the court could reduce your support payment if you are the payer. Another example is if you have significant assets available to you, the court could order you to pay more than what the guidelines’ presumptive amount is.
Adoptions & Terminations
Adoption and termination refer to establishing or terminating the legal parental rights of a child. Adoption is a process whereby a person assumes the parenting of another, usually a child, from that person's biological or legal parent or parents, and, in so doing, permanently transfers all rights and responsibilities, from the biological parent or parents. Terminations may be voluntary or involuntary and both require a court process. We can help in either situation.
